CLAYHALL EXECUTIVE CARS TERMS AND CONDITIONS

These terms and conditions are adopted by all clients of  Clayhall Executive Cars and will apply to all Private Hire as arranged on the customer’s behalf through Clayhall Executive Cars These terms and conditions constitute the entire agreement concerning the arrangements of Clayhall Executive Cars (between you and , Clayhall Executive Cars such that Clayhall Executive Cars act as your agent) and the subsequent provision (making the provision of a booking) of an Airport Transfer, local or Long Distance service (“Service”) between Clayhall Executive Cars (on your behalf) and their clients. Completion of the booking form and use of the service (whether by telephone, text, website, app or such other), indicates your unconditional acceptance of the terms and conditions set out in this agreement.

Any changes sought by the customer; to the terms or conditions shall have no effect unless agreed in writing by Clayhall Executive Cars.

Clayhall Executive Cars is a Private hire Management Company and works on your behalf to make bookings with its clients to provide the customer a safe and reliable transport method. If you require a receipt for your journey, which has been paid by cash, you can obtain one from the main office, although the driver is self employed (and acts as the principle) and therefore any receipt as provided will not be inclusive of VAT or have the same added.”

Definitions

“Clayhall Executive Cars” means and is a trading name of Clayhall Executive Cars Limited

whose registered office is 3 Sevenways Parade, Woodford Avenue, Ilford, Essex, IG2 6XH.

 

Bookings

 

Clayhall Executive Cars, acting on your behalf, will make contact with their clients and on confirmation that your booking has been accepted will email you a quotation for your airport transfer, long distance or local journeys based on the information provided by you. Clayhall Executive Cars reserve the right to amend the quotation if there is any material change to the original itinerary, the number of passengers, or the type of vehicle required.

Clayhall Executive Cars prices are based on passengers being ready to travel at the booked time. The Residential and Business centre pickups are subjected to the first five minutes waiting time free and thereafter 20 pence per minute.

All our fares are quoted as a one pick up to one drop off flat rate and you will be charged per extra drop off.

 

Seat Belt:

 

In accordance with British law seat belts must be worn.

 

Toll Charges:

All incurred tolls will be paid by the hirer

 

Payments:

 

All cash fares are paid to the client in pounds (£) at the end of your journey. Credit card payments can be made online or via telephone. Please note that any online booking made with Clayhall Executive Cars will not be deemed confirmed until payment has been received, (unless you choose the cash option.)

Airport Transfers:

 

You must allow sufficient time when booking your Private Hire Vehicle to allow for the check-in times required by your airline and for any delays caused by traffic conditions. Clayhall Executive Cars and or their clients shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

All Airport pickups include the first 30 minutes waiting time & 1 hour for meet & Greet from the actual landing time of the flight and thereafter you will be charged 20 pence per minute. Number of passengers and luggage’s must be stated clearly during the time of booking. If there any alterations in number, the driver will charge accordingly.

Passengers are responsible for loading and unloading their luggage.

You must order a suitable car size for the number of passengers and luggage. Clients of Clayhall Executive Cars cannot guarantee to carry excessive amounts of luggage. Please note that a child, no matter what age, counts as one passenger.

If you need to transport a wheelchair, please specify this at the time of booking.

Clayhall Executive Cars will always check for flight delays before their client’s driver leaves for the airport but can only rely on the information supplied by the Airport websites. Once you have accepted your quotation, please check your booking confirmation carefully and inform Clayhall Executive Cars promptly for any errors.

Clayhall Executive Cars or its subsequent clients shall not be responsible for any delays caused or costs arising from / by your failure to provide Clayhall Executive Cars with correct information. All car parking charges shall be paid on the day of collection from the airport by the customer unless otherwise stated / agreed in advance.

Payments can be made by credit, debit cards, and cash. A full receipt can be emailed direct to you. Please note that an emailed receipt can take up to 48 hours.

 

 

Account Work:

 

In respect of account work, Clayhall Executive Cars works closely with their clients to ensure that the services are delivered as per the requirements of the customer. At all material times the provision of booking occurs with the clients of Clayhall Executive Cars and Clayhall Executive Cars works as an agent for the customer. Account work carried out will have VAT added at the applicable rate.

The customer agrees to pay Clayhall Executive Cars for all journeys provided by clients of Clayhall Executive Cars on account. Clayhall Executive Cars shall invoice after the journeys has taken place. Invoiced amounts shall be due and payable after 30 days from date of invoice.

Prices for services are quoted exclusive of VAT which shall be charged at the rate prevailing, at the relevant tax point.

 

The Service ‘Vehicle Conduct’:

 

You shall be responsible for the behaviour of all passengers in the car during the whole journey. A charge of £75.00 will be levied to cover the cleaning costs in the unlikely event that the vehicle is soiled by any passenger.

Eating, drinking and/or smoking in the cars is not permitted. Exceptional circumstance for babies and medical reasons will be permitted with prior permission. All children should be restrained in a manner that befits the laws and regulations at the time. Suitable child seats should wherever possible be supplied and fitted by the child’s parents / guardians. These can be held by the driver in the event of a return journey booking. Any client of Clayhall Executive Cars will not carry more passengers than its insurance or licensing allows.

Smoking is not/ never permitted in any vehicles as provided/arranged through Clayhall Executive Cars.

Cancellations and Bookings:

If you need to cancel your booking please contact Clayhall Executive Cars as soon as possible, so that Clayhall Executive Cars can cancel your Private Hire with its designated client. All cancellations made before the booking time will not incur a penalty charge. Clayhall Executive Cars Refunds will be given at the discretion of Management. In exceptional circumstances, a penalty of up to 50% of the fare can be levied for late cancellations.

As a rule, journeys from airports are dispatched up to one hour before flight arrival, journeys within areas we provide a service to are normally dispatched up to twenty minutes before their due time.

Unless otherwise expressly stated, Clayhall Executive Cars will inform the customer at the earliest opportunity that they are unable to assist them in finding a suitable service provider, failing which it is deemed that Clayhall Executive Cars has the respective authority to book the journey on behalf of the customer.

 

Invoices will be sent for cancellations of a booking that have not been pre-paid, these invoices must be paid within 30 days and any unpaid invoices will incur a minimum 10% charge of the original invoice amount. The time stipulated for payment shall be of the essence of the Agreement. Failure to pay within the period specified shall entitle us to write to you and upon the expiration of seven days’ notice, to charge you for costs and expenses incurred in recovering late payments, and to charge interest at the rate then in force pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 as at the due date or on the above rate whichever is the greater. All journeys as arranged with/through Clayhall Executive Cars that are required to be cancelled should be cancelled by phoning the main line contact number and cancelling with the telephone staff.

Refunds to credit / debit cards can only be refunded to the original card used when the original booking was made. Refunds made by cheque can only be made out to the customers’ name that made the original booking.

 

Liability:

All clients of Clayhall Executive Cars shall use all reasonable endeavours to get you to your destination on time but shall not be liable for any loss due to delays caused by road or traffic conditions beyond its control on the journey. Under no circumstances shall clients of Clayhall Executive Cars be liable for any loss of profits, business or for any indirect or consequential loss what so ever. Clayhall Executive Cars and its clients aim at running a reliable service for you, however sometimes cars cannot arrive at time of booking due to reasons beyond our control. If the car is running late please contact the control immediately for an update. Our client’s vehicles are serviced and maintained to the highest levels however in the unfortunate event of breakdown Clayhall Executive Cars & its clients cannot be held responsible.

The driver will travel by the most appropriate route on the day, unless instructed otherwise by the customer.

All luggage is carried entirely at your own risk. Lost property is kept by the office for a period of 12 months before being disposed of. It is the Clients responsibility to ensure that all bags, suitcases and mobile phones are taken from the vehicle. Clayhall Executive Cars is not responsible for any missing or lost property Clayhall Executive Cars is entitled to cancel all services and provide refunds in the event of circumstances beyond their control. If a car breaks down during the journey, Clayhall Executive Cars will make immediate contact to its clients and will have provided an alternative with a practical time allowance.

You shall indemnify Clayhall Executive Cars against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party. All clients of Clayhall Executive Cars act as an agent for clients of self-employed drivers, and will pass information relating to the customer in order to assist with the safe and timely pick up. Clayhall Executive Cars cannot be held responsible for the misuse of this information by its clients or subsequent drivers that are beyond its control.

Neither party excludes or limits its liability for death or personal injury caused by negligence, or for wilful default or fraudulent misrepresentation or otherwise in any manner unenforceable by any applicable law.

 

 

Termination:

Clayhall Executive Cars will refuse to assist with and will terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or your passengers, requesting that all passengers vacate the vehicle as soon as it’s safe to do so.

No refunds will be given for journeys terminated part way through the hire, full fare will be due to the driver and/or invoice issued if the journey is not pre-paid. Clayhall Executive Cars and its clients have the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat to the driver, the vehicle or any other passenger.

Company rights and powers:

Clayhall Executive Cars may change these terms and conditions at any time by posting changes online. Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.

Change the rules or instructions concerning the use of any part of the service from time to time.

Clayhall Executive Cars reserves the right to change the service, suspend it temporarily, in the interest of quality of service, communication failure or part interest of other customers.

Customer Service:

For any issues arising; please contact the control team who will attempt to resolve the issue immediately. In the unlikely instance a satisfactory resolution is not met, you can leave your name and number with the controller and a member of the management team will contact you within 24 hours.

Disputes:

In the unlikely event of an event of a dispute arising, notice must be given within 7 days of the invoice date. In the event of no such notification being received by the company the customer shall accept the amount as being properly due and shall not be entitled to dispute this sum.

Miscellaneous:

Clayhall Executive Cars shall store, process and use all information regarding your personal details in accordance with the requirements of the Data Protection Act 1998 and the GDPR. The terms of this agreement shall prevail if a discrepancy arises between a quotation and this agreement.

This agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals oral or written.

The companies’ website may contain hyperlinks to third parties; The Company does not control, is responsible for and does not endorse any of the contents of such websites.

 

 

 

 

Use Restrictions:

Reproduction, distribution, or republication of any information, materials, documents and services by any means, without the prior express written consent of Clayhall Executive Cars, is strictly prohibited. Nothing in this Clayhall Executive Cars website shall be construed as conferring any license of Clayhall Executive Cars’ intellectual property rights without express written consent from Clayhall Executive Cars. All rights not expressly granted herein are reserved.

Warranties and Disclaimers:

The information, documentation, products and services contained on the Clayhall Executive Cars website are provided “as is,” without any warranty of any kind. Clayhall Executive Cars and its suppliers disclaim all warranties relating to the information, documentation, products and services contained on the Clayhall Executive Cars website, express or implied, including, but not limited to, any warranties against infringement of third party rights, merchantability and fitness for a purpose.

The Clayhall Executive Cars website could include inaccuracies or out-dated information and is subject to change at any time without notice. Your use of this website is at your own risk. You agree to hold Clayhall Executive Cars harmless from and not sue Clayhall Executive Cars for any claims based upon using this website.

In no event shall Clayhall Executive Cars be liable for any direct, indirect, incidental, special, or consequential damages, or damages for loss of profits, revenue, data or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to or use of, this website.

Governing Law and Jurisdiction:

These conditions shall be governed by and construed in accordance with the laws of England. Clayhall Executive Cars controls the Clayhall Executive Cars website from within the country of England. It can, however, be accessed from other places around the world. Although these places may have different laws from those of England, by accessing the Clayhall Executive Cars website you agree that the laws of England, without regard to rules relating to conflict of laws, will apply to all matters relating to your use of the site. You and Clayhall Executive Cars also agree to submit to the non-exclusive jurisdiction of the English courts, with respect to such matters. Users of the Clayhall Executive Cars website accessing it from places outside of England acknowledge that they do so voluntarily and are responsible for complying with local laws.

These terms and conditions do not remove or affect your statutory rights.

If you do not agree to the terms, please do not use the CEC Cars iPhone/Android booking app.

  • The CEC Cars iPhone and Android app is developed and maintained by a third-party software developer, Cordic cPAQ. While we can pass comments or feedback about the app on to the developers, please note that our telephone call operators cannot offer technical assistance such as troubleshooting or device compatibility information to users. Please pass any feedback to us by contacting our Email address Here.
  • While bookings can be made through the app for immediate dispatch, please be aware that changes in circumstances such as breakdowns, road closures etc. may affect estimated waiting times and cause fluctuations in vehicle ETAs. If you require a minicab immediately, please contact the office by phone and an operator will confirm the status of your booking.
  • It is your responsibility to plan your journey correctly and leave sufficient time to reach the destination according to the need to check-in for flights, catch a train or any other constraints you might have. CEC Cars recommends that absolutely all customers plan to arrive at their destination at least thirty minutes in advance of any train, coach departure or airport check-in time.
  • CEC Cars in no way agrees to any contract or commitment to deliver customers to pre-booked connections, transport, dinner reservations, personal arrangements or medical appointments under any circumstances. Customers must take full responsibility for ensuring they are able to make such appointments on time. CEC Cars are unable to offer a refund for costs incurred due to lateness for any pre-arrangement in any circumstances. This applies to any journeys CEC Cars agrees to undertake (including both minicabs and coach hires) and through any booking method, including by phone, smartphone app, email, or website booking form.
